Terms of Use

1. Provider and scope

These terms govern the use of the Mutual app and the associated website. By creating an account or using the app, you agree to them.

2. What Mutual does

Mutual lets you identify songs through music recognition and organise them into collections – on your own or together with others. Identified tracks are shared with the members of a collection and can be commented on, given emoji reactions, and played on via links to Spotify and Apple Music. The basic version is free and ad-supported.

3. Account and minimum age

• An account is required (sign-in via Google or phone number).
• Use is permitted from the age of 16; younger users need the consent of a parent or guardian.
• You are responsible for the security of your account and must not pass it on to third parties.

4. Your content

Your profile name, profile picture, collection photos, comments and reactions remain your content. You grant us the simple, revocable right to store them for the operation of the app and to display them to the members of your collections. Each track shows who discovered it.

You warrant that your content does not infringe the rights of third parties (in particular for uploaded photos), and you indemnify us against justified third-party claims arising from a culpable breach of that obligation.

5. Rules of conduct

The following are not permitted:

• insulting, discriminatory, pornographic or otherwise unlawful content (e.g. in comments, profile or collection images),
• harassment of other members, spam or promotional use,
• interference with technical operation, automated access, circumvention of security or limit mechanisms,
• decompilation or reverse engineering, except where expressly permitted by law.

In case of violations we may remove content and suspend or permanently close accounts. Admins of a collection can remove members from it and delete individual tracks within it – including tracks contributed by other members.

6. Music recognition and third-party services

Music recognition uses ShazamKit (Apple). We give no guarantee of recognition or of the accuracy of the match data (title, artist, cover art, links). Spotify and Apple Music links lead to offerings of the respective providers, who are themselves responsible for their content and terms.

For the Spotify export we create the playlist on a central Mutual Spotify account and provide you with the link; you do not need a Spotify account of your own for this. Anyone who has the link can open the playlist. We cannot promise that exported playlists remain available permanently – so save important lists to your own account (in Spotify via "Add to other playlist").

6a. Labelling of AI-generated music

Mutual labels identified tracks where there are indications that they come from an AI-generated artist. This is based on the classification of the music service Deezer and – if no information is available there – an automated evaluation of publicly accessible sources by a language model. The app states in each case what the label is based on.

This label is an automated assessment, not a statement of fact. It may be incorrect, it is generated without individual human review, and it is not to be understood as a statement about the artistic quality, authorship or lawfulness of a work. Users can switch the display off at any time in the app (Profile → "AI detection").

Artists who consider a label to be incorrect can contact us informally at hi@mutual.audio. We will review the notice and remove or correct the label promptly.

7. Mutual Pro

• Mutual Pro is a one-time purchase (not a subscription) and is processed through Google Play; the Google Play terms apply in addition, including for withdrawal and refunds.
• Pro currently includes: no advertising, Spotify export of collections (see section 6) and a home screen widget. We continue to develop the feature set.
• The purchase status is tied to your account and can be reactivated via "Restore purchases".

8. Availability and further development

Mutual is offered free of charge or for a one-time amount. We strive for reliable operation but do not owe any particular level of availability. We may develop, change or discontinue features; we will discontinue the service as a whole only with reasonable advance notice, so that you can secure your content (e.g. via Spotify export or links).

9. Liability

We are liable without limitation for intent and gross negligence, and for damage resulting from injury to life, body or health. In cases of simple negligence we are liable only for the breach of material contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place), limited to the damage typically foreseeable for this type of contract. Liability under the German Product Liability Act remains unaffected. For loss of content we are liable only to the extent that such loss would not have occurred had we carried out proper data backup.

10. Term and termination

You can stop using the service at any time and delete your account in the app (Profile → Delete account); this deletes your profile and private content. Our right to suspend accounts in case of violations (section 5) remains unaffected.

11. Changes to these terms

We may adapt these terms with effect for the future, for example in the case of new features or a changed legal situation. We will announce material changes in the app or on the website; if you do not object within six weeks or continue to use the app, the changes are deemed accepted. We will point this out separately in the change notice.

12. Final provisions

• German law applies. If you are a consumer, mandatory consumer protection provisions of your country of residence remain unaffected.
• If individual provisions are invalid, the remainder stays in effect.
• European Commission platform for online dispute resolution: ec.europa.eu/consumers/odr. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body.
